BLUE DUCK TECH SDN. BHD. (1298941-K) (“BLUEDUCK”, “we”, “us”, “our”) respects your privacy and is committed to protecting your personal information. We want to be transparent with you about how we collect and use your personal information.
This Privacy Notice (“Notice”) sets out our personal information processing practices, and your rights and options regarding the ways in which your personal information is collected (including through our website, www.blueduck.my (“Site”) and web portal (through which you sign up to our services)) and used in accordance with applicable data privacy law.
THIS NOTICE CONTAINS IMPORTANT INFORMATION ABOUT YOUR PERSONAL RIGHTS TO PRIVACY. PLEASE READ IT CAREFULLY TO UNDERSTAND HOW WE USE YOUR PERSONAL INFORMATION.
THE PROVISION OF YOUR PERSONAL INFORMATION TO US IS VOLUNTARY. HOWEVER, WITHOUT PROVIDING US WITH YOUR PERSONAL INFORMATION, YOUR USE OF OUR SERVICES OR YOUR INTERACTION WITH US MAY BE ADVERSELY IMPACTED. FOR EXAMPLE, YOU WOULD NOT BE ABLE TO RECEIVE OTHER CONTENT THAT MAY BE OF INTEREST AND RELEVANCE TO YOU.
1. When do we collect personal information about you
Before you read any further, it might be useful to explain what we mean by “personal information”. The relevant legal definition can be found here. In brief, it is information which relates to you and from which you can be identified, whether from that information alone; or from that information combined with other information. Note however that it does not include ‘anonymous data’ (i.e., information from which you cannot be identified, for example website usage statistics).
We collect personal information in the following ways:
A. When you give is to us directly and voluntarily
For example, personal information that you submit to us when you fill in forms on our website or web portal to use our BD Zero Deposit, registration service or referencing service, make a payment using BD Pay, subscribe to our services or marketing communications, request further services, enter a promotion, report a problem with our website, complete a survey, or communicate with us (by phone, email, in person or otherwise).
B. When you visit our website or use our web portal
When you visit or use our website or web portal, we automatically collect the following types of personal information:
- technical information, including the internet protocol (IP) address used to connect your device to the internet, browser type and version, time zone setting, browser plug-in types and versions and operating systems and platforms; and
- information about your visit to our website, including the uniform resource locator (URL) clickstream to, through and from the website (including date and time), services you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling and clicks) and methods used to browse away from the page).
C. When we obtain it indirectly
We also collect your personal information from third party sources. For example, your personal information may be shared with us by our select business partners: property management company, property agencies and other related services. We may also obtain your personal information from publicly available third-party sources, such as social media accounts (depending on your privacy settings). To the extent we have not done so already, we will notify you when we receive personal information about you from such sources and tell you how and why we intend to use that personal information.
In general, we may combine your personal information from these different sources for the purposes set out in this Notice.
D. When it is publicly available
For example, if you interact with us on social media and depending on your privacy settings, certain information about your user account or profile (such as username, profile picture or other details in your profile).
2. What personal information do we use?
We may collect, store and otherwise process the following kinds of personal information:
- your name and contact details (including emergency contacts) such as postal address, telephone number and email address;
- date of birth, gender and nationality;
- marital status and details of dependents;
- your user account details, such as username and password;
- your date of birth and gender;
- your financial information, including, credit report, income level (requested, or calculated from level of rent) and information such as bank details and/or credit/debit card details, account holder name and account number;
- information relevant to payment of tax;
- information relevant to payment of utility bills;
- information turned out by background searches which we are obliged by law to carry out;
- information related to social media accounts or profiles;
- transaction history and details between landlords and tenants;
- information relevant to potential disputes between landlords and tenants;
- information about your computer/mobile device and your visits to and use of our website, including, for example, your IP address and geographical location;
- information about our services and products, or our selected partners’ services and products, which we consider may be of interest to you;
- if applicable, your details as a landlord including property address(es), business or residential address;
- if applicable, your details as a tenant including rent payment history, any previous damage to a property and how this was dealt with and past deadlines with landlords; and/or
- any other personal information which you choose to share with us as per section 1.
3. Do we collect “sensitive personal data” ?
Applicable data privacy law recognises certain categories of personal information as sensitive and therefore requiring more protection, for example information about your health, ethnicity and religious beliefs. This is known as “sensitive personal data”.
Subject to section 40 of PDPA, we may collect and use such personal data. For example, we may need to deal with medical information in relation to landlords or tenants who could be regarded as vulnerable customers. We may also collect personal information about criminal offences (including alleged offences), for example if revealed via a background search or if committed / alleged to have been committed during the course of a tenancy.
4. How and why do we use your personal information?
We mainly collect and use personal information because we can’t perform our Services otherwise. In general, we use your personal information to achieve the purposes set out in this Notice. In particular:
- to personalise, administer and manage your account and the web portal
- to assess and process your application(s)/request(s) for our Services;
- for the purposes of the Services such as providing, improving and developing the Services;
- to verify your financial standing through credit reference checks
- to assess financial and insurance risks;
- to promote security of the Services;
- to communicate with you including but not limited to sharing materials such as newsletters and articles, distribute information of events, conferences, talks and seminars which may be of interest to you;
- to prevent fraud and/or misuse of Services;
- to make any appropriate adjustments for vulnerable customers;
- to provide such necessary information to any regulatory or governmental authorities as required by statutory, regulatory or governmental requirements;
- to defend and/or enforce legal claims;
- to conduct financial planning analysis and assessment to provide accurate, independent, customised and comprehensive plan to you;
- to send important notices, push notifications on mobile devices, emails, letters, short messaging service (SMS) and WhatsApp messages, like communications about purchases and changes to our terms, conditions, and policies;
- to share your Personal Data with our trusted business partners and agents for the purposes of (but not limited to) fulfillment of customer orders, processing and delivery of financial products to you; and/or
- for any of the purposes relating to the above.
5. Lawful basis for data processing
Data privacy law requires us to rely on one or more from a set of “lawful bases” to collect and use your personal information. In short, these are six reasons recognised by regulators as giving us lawful grounds to collect and use your personal information.
We consider the grounds listed below to be relevant:
- Where you have provided your consent for us to use your personal information in a certain way (for example, we will ask for your consent to collect your personal information by using cookies or other tracking technologies, or to send you marketing material by email);
- In order for us to comply with a legal obligation which is binding on us (for example, where we are obliged to share your personal information with regulatory bodies which govern our work and services);
- Where necessary for the performance of obligations under a contract to which you are a party or to take steps at your request prior to entering a contract (for example, to collect a deposit or to provide a reference); or
- Where there is a legitimate interest in us doing so.
Applicable data privacy law allows us to collect and use your personal information if it is reasonably necessary to achieve our, your or others’ legitimate interests (as long as that use is fair, balanced and does not unduly impact your rights).
In brief, “legitimate interests” is a broad concept and can potentially include any reasonable, legitimate and valid objective (whether commercial or otherwise). Our legitimate interests could, for example, include provision, promotion or improvement of our products and services.
When we process your personal information to achieve such legitimate interests, we consider and balance any potential impact on you (both positive and negative), and your rights under applicable data privacy law. We will not use your personal information for activities where our interests are overridden by the impact on you, such as where that use would be excessively intrusive (unless, for instance, we are otherwise required to or permitted to by law).
6. Disclosure of your personal data
We will never sell or rent personal information for marketing or any other purposes. However, we will share your personal information with selected third parties where required by law, where it is necessary to administer our working relationship with you or where we have another valid and lawful reason for doing so, including if you have given your consent.
Those selected third parties include:
- sub-contractors for the performance of any contract we enter into with them, for example IT service providers such as website hosts or cloud storage providers, payment service providers, benefits service providers, credit rating companies or debt recovery service providers;
- professional advisers or service providers, such as lawyers, accountants, auditors and insurers such as banks and insurance provider;
- regulatory authorities, such as tax authorities, if our use of your personal information requires reporting in certain circumstances;
- parties assisting us with research to monitor the impact/effectiveness of our work and services, for example analytics providers who help us evaluate your use of our website and web portal, provide reports on how the website is used and let us know which content is most popular. Please see our cookie notice for further information; and
- parties relevant to any corporate transaction relevant to BLUEDUCK.
We may also need to disclose your personal information to third parties:
- in the event that we sell or buy any business or assets, in which case we may disclose your personal information (solely as relevant to the transaction) to the (prospective) seller or buyer of such business or assets;
- if substantially all of our assets are acquired by a third party, personal information held by us may be one of the transferred assets;
- If we are under any legal or regulatory duty to do so; and/or
- to protect the rights, property or safety of BLUEDUCK, its personnel, users, visitors or others.
Where appropriate, we require third parties to enter into contracts with us which place obligations on them to protect your personal information in line with our policies and procedures and our obligations under applicable data privacy law.
7. Data storing
We will only keep your data for as long as it is needed.
Length of Time
Upon signing up for our Services
We process and store your personal data as long as it is necessary for the fulfillment of our contractual obligations.
Upon termination or expiration of our Services
We will keep all information, personal or otherwise, for seven years following the end of our Services including but not limited to non-continuation of the BD Zero Deposit Insurance Solution or BD Pay, end of your claims and recoveries process etc..
8. Transfer of data
We do not share with or transfer to third parties your Personal Data, except for circumstances where we have a good-faith belief that access, use, transfer or disclosure of such information is reasonably necessary or appropriate for the purposes of data storage or processing or providing any service or product on our behalf to you (including for the purposes set out in Clauses 4 and 6 above). We ensure that such information is provided to members of our Group companies and their affiliates and our trusted business partners and agents within or outside the country in which we or they are established, under conditions of confidentiality and similar levels of security safeguards.
9. Information collected by third parties
We, and third parties, may from time to time make software applications downloads available for your use on or through the Services. These applications may separately access, and allow a third party to view, your identifiable information, such as your name, your user ID, your computer's IP Address or other information such as any cookies that you may previously have installed or that were installed for you by a third party software application or website. Additionally, these applications may ask you to provide additional information directly to third parties. Third party products or services provided through these applications are not owned or controlled by BLUEDUCK. You are encouraged to read the terms and other policies published by such third parties on their websites or otherwise.
10. Disclaimer regarding security and third party sites / data center
We do not guarantee the security of personal data and/or other information that you provide on third party sites/ data center.
In an attempt to provide you with increased value, we may choose various third party websites to link to, and frame within our website. These linked sites have separate and independent privacy policies as well as security arrangements. Even if the third party is affiliated with us, we have no control over these linked sites, each of which has separate privacy and data collection practices independent of us. Data collected by our partners or third party web sites (even if offered on or through our Site) may not be received by us. We therefore have no responsibility or liability for the content, security arrangements (or lack thereof) and activities of these linked sites. These linked sites are only for your convenience and you therefore access them at your own risk. Nonetheless, we seek to protect the integrity of our Site and the links placed upon each of them and therefore welcome any feedback about these linked sites (including, without limitation, if a specific link does not work).
11. What If Personal Data Provided By You Is Incomplete?
Where indicated, it is obligatory to provide your personal data in a complete manner to enable us to process your application for our Services. Otherwise, we may not be able to process your application/request or provide you with our Services.
12. Your Rights To Access And Correct Your Personal Data
Subject always to the exceptions and restrictions as may be contained under the applicable laws, you may at anytime hereafter request for access to your personal data or request for correction of your personal data or limit the processing of your personal data by us. These Terms govern your use of our website www.blueduck.my (“Site”) operated by BLUE DUCK TECH SDN. BHD. (1298941-K), a company incorporated in Malaysia with its principal place of business at Menara IGB, Mid Valley City Suite 8.01, 8th Floor, 59200, Kuala Lumpur, Malaysia (“BLUEDUCK” or “we” or “our” or “us”), a Malaysian entity, either itself or through its subsidiaries or licensees, via our site at and any other platforms designated by us.
By using our Site, you accept these Terms and agree to comply with them
If you do not agree to these Terms, you must not use our Site.
For avoidance of doubt, these Terms apply to all visitors, users and others who wish to access or use of the Site including but not limited to a landlord, potential tenant or property agents etc..
Description of Services
The website is a free to use online consumer web portal for proptech and insurance products. Our products and services include aggregation of digital innovations and services, direct purchase of insurance products, promotions and other value-added services including in-house payment system. Any monetary exchange for any financial product (i.e. Blue Duck Smart Commercial, BD Zero Deposit, TenancyCash) will be between yourself and the respective insurer and/or banks.
1. Use of Services
1.1. Purchase of Insurance on the Site
Our collaboration with insurance providers allow us to provide online transaction services for insurance products. We are a registered agent under PIAM to represent any insurer in distributing general insurance products. You may authenticate and confirm the same with PIAM by verifying our details in the agent search module on PIAM website.
A purchase of an insurance policy does not indicate a contract between you and BLUEDUCK. Rather, the contract of insurance is between you and the respective insurer. As such, by your purchase of an insurance policy offered by the insurance provider, you are bound to the specific terms and conditions governing the insurance policy stipulated by the respective insurer.
1.2. Tenant Profiling
To improve transparency and credibility, BLUEDUCK offers Tenant Profiling as a screening service to conduct checks on a prospective tenant via CTOS. This fully-digitised solution provides property agents and landlords with a more reliable approach in the selection process on potential tenants (individual/organization). By successfully completing a self-background check, tenants are granted with a verified status. In granting verified status, BLUEDUCK pass no judgment whatsoever on the character, quality or level of professionalism of the tenant involved. The tenant is responsible for the adequacy and accuracy of the information provided. BLUEDUCK reserves the right to revoke verified status on individuals and organisations if investigations find that information provided in applying for verified status was false or has since become invalid.
1.3. BD Pay
BLUEDUCK is a registered merchant under Payments Network Malaysia Sdn Bhd (Paynet), a wholly owned subsidiary of Bank Negara Malaysia. You may register for the services through our portal and you acknowledge that BLUEDUCK reserves the right to reject any registration by giving notification to you without assigning any reason.
Under no circumstances will BLUEDUCK be liable for any indirect or incidental loss, operating losses, consequential damages, claims by third parties and/or lost data, profits, revenue, customers, goodwill or interest. BLUEDUCK shall not be liable to the user for any damage caused by the suspension of the service. BLUEDUCK’s liability for direct damages shall be limited to an amount that is equivalent to the service charges that the user has paid to BLUEDUCK under the said agreement during twelve (12) months prior to the damage.
In collaboration with banking institutions, BLUEDUCK offers an advance of pay (Loan) to landlords. As such, by your application of the Loan to the bank, you are bound to the terms and conditions of such service set by the bank.
Note that this will not include investment advice, asset management, and/or assistance with execution of the transactions involved. You acknowledge that BLUEDUCK does not provide tax, accounting or legal advice. We may address tenancy management issues as they relate to our core product, however you should understand that any information provided is not considered or intended to be legal, accounting or financial advice. For legal advice, you should consult with an attorney, for tax advice a qualified tax professional and for financial advice a professional advisor. None of the fees which we charge are for tax, accounting and legal advice.
BLUEDUCK shall not be liable for any damages or losses caused by loan application that were made based on the information, data and representations provided by you, or by your representatives. You further acknowledge that any loan recommendations made by the bank as a result of the financial plan are based upon the professional judgment of bank, and BLUEDUCK does not guarantee the results of the loan application.
1.5 Zero Deposit Program
Through BLUEDUCK’s Zero Deposit Program, Landlord will be covered for their loss of rent in the specific event of a Default in Rental or Runaway Tenant during the period of coverage as per stated in Certificate of Contract. For more information, kindly refer to Zero Deposit Program terms and conditions set out below.
In registering an account:
- You shall provide us with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms, which may cause an adverse impact in your access to our Services.
- To fully access or use the Site, you are required to register for an account by providing, among others, your name, email address and password.
- You shall not select or use as an account a name of another person with the intent to impersonate that person; use as an account a name subject to any rights of a person other than you without appropriate authorization; or use as an account a name that is otherwise offensive, vulgar or obscene.
- We reserve the right to refuse registration of, or cancel an account in our discretion. You shall be responsible for maintaining the confidentiality of your password.
- Unless specifically stated otherwise, the account is personal to you and cannot be shared with third parties or transferred to third parties.
You understand that all information, images, pictures, data, text, music, sound, photographs, graphics, video, messages, or other materials (“Content“), whether publicly posted or privately transmitted, is the exclusive work and property of the person from whom such Content originated.
We do not claim any permanent ownership of your Content. You retain copyright and any other rights you already hold in Content which you submit, post, upload or display on or through the Site.
When you submit, post, upload or display Content, you grant us a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license (and sub-licensable) to use, exploit and archive the Content in accordance with or as reasonably contemplated by this Agreement.
When you post, submit, or upload Content on the Site you represent and warrant that: you own all copyright in the Content, or if you are not the owner, that you have permission to use the Content, and that you have the right to display and reproduce the Content via the Site. Blue Duck has the right but not the obligation to monitor and edit all Content provided by users.
In addition, Content found on or through this Service are the property of BLUEDUCK or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
4. Copyright and Trade Marks
The content of this website are BLUEDUCK’s. Reproduction of part or all of the contents in any form is prohibited other than in accordance with the following permissions:
Licence to re-copy for Limited Purposes:
- You acknowledge BLUEDUCK as the source of the material. You must include such acknowledgement and the BLUEDUCK web address in the copy of the material, and
- You must inform the third party that all the Terms and Conditions set out herewith apply to him/her and that he/she is bound by them.

- modify, disrupt, impair, alter or interfere with the use, features, functions, operation or maintenance of the Site or the rights or use and enjoyment of the Site by any other person;
- post or provide false, inaccurate, misleading, incomplete, defamatory or libelous content;
- take any action that may undermine any ratings system that we may use;
- transfer your account and user identification to another party without our consent;
- harvest or otherwise collect information about users, including email addresses, without their consent;
- upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
- use any automated device, software, process or means to access, retrieve, scrape, or index our platform or any content on our website;
- use any device, software, process or means to interfere or attempt to interfere with the proper working on our website;
- undertake any action that will impose a burden or make excessive traffic demands on our infrastructure that we deem, in our sole discretion to be unreasonable or disproportionate site usage
We reserve the right, in our sole discretion, to reject, edit or refuse to post any Content and to remove any Content from the Site, whether or not the Content is expressly prohibited by this Agreement, or to restrict, suspend, or terminate your access to all or any part of the services at any time, for any or no reason, with or without prior notice, and without liability.
You agree to adhere to our guidelines and if you fail to do so, we reserve our right to suspend or terminate your account. We also reserve our rights to introduce, change or amend our guidelines from time to time.
7. Confidential Information
We will not disclose or use your Confidential Information and likewise, you will not disclose or use our Confidential Information.
“Confidential Information” means any information disclosed or made available to you by us, directly or indirectly, whether in writing, orally or visually. It includes but is not limited to all information contained within our reporting systems and other performance metrics and any other technical or programming information we disclose or make available to you.
However, Confidential Information does not include information other than information that: is or becomes publicly known and generally available other than through your action or inaction; or was already in your possession (as documented by written records) without confidentiality restrictions before you received it from us.
You acknowledge, consent and agree that we may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to:
- comply with legal process;
- enforce this Agreement;
- respond to claims that any Content violates the rights of third parties;
- respond to your requests for customer service; or
- protect our rights, property or personal safety, our users and the public.
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. Nevertheless, you may inform us of such dispute for our records but we are not responsible resolve or arbitrate or mediate such dispute.
9. Marketing and Notifications
This Site may display advertisements and promotions. We will also send you information containing advertisements and promotions of our affiliates and partners. As consideration for access to and use of the Site, you agree that we may place advertising on the Site at our sole discretion. You agree that we may change the manner, mode and extent of advertising on the Site without further notice.
You may unsubscribe by contacting us or using the unsubscribe option in the email updates that we forward to you.
You agree to indemnify, defend and hold us, our agents, affiliates, shareholders, subsidiaries, directors, officers, employees, and applicable third parties (e.g. syndication partners, licensors, licensees, consultants and contractors) (collectively “Indemnified Person(s)”) harmless from and against any and all third party claims, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s), arising out of, related to or which may arise from your use of the Site and/or your breach of any term of this Agreement.
11. Suspension and Termination
We may suspend or terminate your access to all or any part of the Site at any time, with or without cause, effective immediately. You may terminate your use of the Site at any time, provided that all provisions of this Agreement, which shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. We will suspend or terminate your access to the site if you are determined to be, in our sole discretion, a repeat infringer of this Agreement.
We also reserve the right to suspend or cancel your account that has been inactive for extended periods of time.
We may, but shall not be obligated to, give you one warning if you have violated this Agreement prior to suspension or termination of your account.
12. After Termination
In the event that this Agreement terminates for whatsoever reasons, the following shall be applicable:-
- your access to the Site shall immediately terminate; you shall continue to comply with all of the obligations on your part under this Agreement which are not affected by the termination;
- we reserve the right to permanently dispose and delete any data held in the Site without further reference to you; and
- any claim which either party may have against the other in respect of any breach or non-performance or repudiation of any of the provisions of this Agreement which shall have occurred prior to such termination shall not be affected or prejudiced.
We reserve the right to change our terms and conditions herein from time to time. We may change any or all aspects of services provided by the Site at any time and without notice. Nothing in this Agreement will constrain how we operate our business. You shall be responsible for reviewing and becoming familiar with any such modifications.
If the alterations constitute a material change to our terms and conditions, we will notify you by posting a notification on this Site. Use of the services by you following such notification constitutes your acceptance of the terms and conditions as modified.
What constitutes a “material change” will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
14. General Terms
This Agreement will be governed by the laws of Malaysia and parties agree that any dispute or claim between you and us will be adjudicated in the courts in Malaysia. Any claim against us arising from the Agreement shall be adjudicated on an individual basis, and shall not be consolidated in any proceeding with any claim or controversy of any other party.
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
If any of these terms and conditions of this Agreement is unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other part of this Agreement will not be affected.
You are solely responsible for accessing the information contained on the Site and any reliance you may place on such information is done solely at your own risk. We are not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of such information appearing on this Site.
We do not guarantee or warrant that the data stored in our server or generated by the Site will be backed up. You are also responsible for maintaining accurate data. However, in the event that your records do not correspond with our records, the latter shall prevail

DIRECT DEBIT SERVICES TERMS AND CONDITIONS
By completing the Direct Debit Authorisation and accepting these Terms and Conditions the Account Holder authorises the Bank to arrange for funds to be debited from the Account Holder’s Account including any relevant transaction fees/charges in using the Direct Debit Service which is not payable by the Corporation.
Dengan melengkapkan Kebenaran Direct Debit dan menerima Terma dan Syarat ini, Pemegang Akaun telah memberi kebenaran kepada pihak Bank untuk menguruskan dana yang akan didebitkan dari Akaun milik Pemegang Akaun termasuk sebarang bayaran/caj transaksi yang berkaitan dengan penggunaan Perkhidmatan Direct Debit yang tidak ditanggung oleh Syarikat.
These Terms and Conditions may be superseded by variations, revisions or changes at any time, giving prior written notice to the Account Holder. Such amendments shall become effective on the date of such notice and the Account Holder’s continued usage of the Direct Debit Service shall constitute an acceptance of the said amendments.
Terma dan Syarat ini boleh digantikan dengan sebarang pengubahsuaian, semakan atau perubahan pada bila-bila masa dengan memberikan notis bertulis kepada Pemegang Akaun. Sebarang pindaan akan berkuat kuasa pada tarikh notis tersebut, dan dengan penggunaan berterusan Perkhidmatan Direct Debit, Pemegang Akaun akan dianggap sebagai telah menerima pindaan tersebut.
- Definitions / Definisi
“Account” refers to any one or more accounts (current account, savings account, card account) which the Account Holder opens and maintains with the Bank.
"Akaun" merujuk kepada mana-mana satu atau lebih dari satu akaun (akaun semasa, akaun simpanan, akaun kad) yang dibuka dan diuruskan oleh Pemegang Akaun dengan Bank.
"Account Holder” refers to an individual (single or joint account), sole proprietorship, partnership, company or entity named in the Direct Debit Authorisation form who applies for the Direct Debit Service with the Bank.
"Pemegang Akaun" merujuk kepada individu (akaun tunggal atau bersama), pemilik tunggal, perkongsian, syarikat atau entiti yang dinamakan dalam Borang Kebenaran Direct Debit untuk Perkhidmatan Direct Debit dengan Bank.
"Bank" refers to the Account Holder's financial institution which maintains the Account Holder’s Account for the purposes of facilitating the Direct Debit collection in accordance with the Account Holder’s Payment/Deduction Instruction.
"Bank" merujuk kepada institusi kewangan Pemegang Akaun yang mengendalikan Akaun milik Pemegang Akaun bagi tujuan urusan kutipan Direct Debit berdasarkan Arahan Pembayaran/Arahan Pemotongan dari Pemegang Akaun.
"Corporation" refers to a company, private entity, private corporation, public corporation or government body incorporated and registered in Malaysia that subscribes to the Direct Debit Service.
"Syarikat" merujuk kepada sebuah syarikat, entiti swasta, syarikat swasta, perbadanan awam atau badan kerajaan yang ditubuh dan didaftarkan di Malaysia dan melanggan kepada Perkhidmatan Direct Debit.
“Direct Debit Authorisation” refers to the Authorisation or mandate given by the Account Holder to the Corporation and Bank to initiate the Direct Debit collection directly from the Account Holder’s current account, savings account or card account.
"Kebenaran Direct Debit" merujuk kepada kebenaran atau mandat yang diberikan oleh Pemegang Akaun kepada pihak Syarikat dan Bank untuk pengurusan kutipan Direct Debit secara terus dari akaun semasa, akaun simpanan dan/atau akaun kad milik Pemegang Akaun.
"Direct Debit Operator" refers to Payments Network Malaysia Sdn. Bhd. (PayNet).
"Pengendali Direct Debit" merujuk kepada Payments Network Malaysia Sdn. Bhd. (PayNet).
"Direct Debit Service" refers to the service provided by Direct Debit Operator for the collection of payments directly from the Account Holder's Account in accordance with Payment/Deduction Instruction received from the Corporation.
"Perkhidmatan Direct Debit" merujuk kepada perkhidmatan yang disediakan oleh Pengendali Direct Debit untuk kutipan pembayaran-pembayaran secara terus dari Akaun milik Pemegang Akaun mengikut Arahan Pembayaran/Arahan Pemotongan yang diterima oleh pihak Syarikat.
“Payment/Deduction Instruction" refers to an instruction given by the Corporation to its Bank to arrange for a specified amount of funds to be collected from the Account Holder’s Account in accordance with the authorisation provided by Account Holder when subscribing to the Direct Debit Service.
"Arahan Pembayaran/Arahan Pemotongan" merujuk kepada arahan yang diberikan oleh pihak Syarikat kepada pihak Bank bagi menguruskan kutipan sejumlah dana yang tertentu dari Akaun milik Pemegang Akaun berdasarkan kebenaran yang telah diberikan oleh Pemegang Akaun apabila melanggan kepada Perkhidmatan Direct Debit.
"Registered Holder" refers to the name of the person/company who subscribes to a specific service with the Corporation.
"Pemegang Berdaftar" merujuk kepada nama Individu/syarikat yang melanggan kepada perkhidmatan tertentu dengan pihak Syarikat.
"Terms and Conditions" refers to the terms and conditions of the Direct Debit Service between the Account Holder and the Bank as specified in the Direct Debit Authorisation form.
"Terma dan Syarat" merujuk kepada terma dan syarat Perkhidmatan Direct Debit antara Pemegang Akaun dengan pihak Bank seperti yang dinyatakan di dalam Borang Kebenaran Direct Debit.
- Account Holder Declaration / Deklarasi Pemegang Akaun
2.1. The Account Holder declares that all information provided in the Direct Debit Authorisation form is accurate, true and correct to the best of the Account Holder’s knowledge and the Account Holder is aware of the content and the scope of the Direct Debit Service provided.
2.1. Pemegang Akaun mengisytiharkan bahawa semua maklumat yang diberikan di dalam Borang Kebenaran Debit Direct adalah tepat, benar dan betul di dalam pengetahuan Pemegang Akaun dan Pemegang Akaun sedar dengan kandungan dan skop Perkhidmatan Direct Debit yang disediakan.
2.2. The Account Holder shall ensure and undertakes that the Direct Debit Authorisation form is not provided with fraudulent intent or by any person acting on behalf of the Account Holder.
2.2. Pemegang Akaun hendaklah memastikan dan beraku janji bahawa Borang Kebenaran Direct Debit yang diberikan tidak mengandungi sebarang unsur penipuan atau oleh mana-mana individu yang bertindak bagi pihak Pemegang Akaun.
2.3. The Account Holder has read and understood and agrees to be bound by the Terms and Conditions as specified herein.
2.3. Pemegang Akaun telah membaca, memahami dan bersetuju untuk terikat dengan Terma dan Syarat ini.
- Account Holder Obligations / Kewajipan Pemegang Akaun
3.1. The Account Holder is responsible:
3.1. Pemegang Akaun adalah bertanggungjawab:
i. to ensure that the name of the Registered Holder stated in the bill corresponds with name in the Corporation's record;
i. untuk memastikan bahawa nama Pemegang Berdaftar yang dinyatakan dalam bil adalah bertepatan dengan nama dalam rekod pihak Syarikat;
ii. to ensure sufficient funds in its Account for the Bank to act in accordance with the Payment/Deduction Instruction when it is due;
ii. untuk memastikan dana yang mencukupi di dalam Akaun untuk membolehkan pihak Bank mengambil tindakan berdasarkan Arahan Pembayaran/Arahan Pemotongan apabila telah tiba masanya;
iii. to settle any outstanding amounts directly with the Corporation in the event the Payment/Deduction Instruction could not be affected due to situations including, but not limited to, the Payment/Deduction Instruction exceeds the Account Holder’s Account limit amount or frequency;
iii. untuk menyelesaikan sebarang jumlah tertunggak terus dengan pihak Syarikat apabila Arahan Pembayaran/Arahan Pemotongan tidak boleh dilaksanakan disebabkan keadaan tertentu termasuk, tetapi tidak terhad kepada, Arahan Pembayaran/Arahan Pemotongan telah melebihi jumlah had atau kekerapan yang dibenarkan oleh Akaun milik Pemegang Akaun;
iv. to ensure that the Direct Debit Service is not used for any unlawful activity including but not limited to, online betting and/or gambling activities.
iv. untuk memastikan bahawa Perkhidmatan Direct Debit tidak digunakan untuk sebarang aktiviti yang menyalahi undang-undang termasuk, tetapi tidak terhad kepada, pertaruhan atas talian dan/atau aktiviti perjudian.
3.2. If the Account Holders Account is overdrawn due to insufficient funds:
3.2. Jika Akaun Pemegang Akaun dikeluarkan melebihi had disebabkan dana yang tidak mencukupi:
i. a fee and/or interest may be charged to the Account Holder’s Account by the Bank;
i. sebarang bayaran dan/atau faedah boleh dikenakan kepada Akaun milik Pemegang Akaun dengan pihak Bank;
ii. for future Payment/Deduction Instruction, the Account Holder agrees and authorizes the Bank to re-attempt to debit the amount due from the Account Holder’s Account on any other date(s) subject to further instruction(s) from the Corporation.
ii. untuk sebarang Arahan Pembayaran/Arahan Pemotongan bagi masa yang akan datang, Pemegang Akaun bersetuju dan membenarkan pihak Bank mencuba kembali untuk mendebitkan amaun yang perlu dibayar dari Akaun milik Pemegang Akaun pada sebarang tarikh lain tertakluk kepada arahan daripada pihak Syarikat.
- Banks Obligations / Kewajipan Pihak Bank
4.1. The Bank shall be authorised to collect the Direct Debit payment(s) from the Account Holder’s Account upon receiving the Payment/Deduction Instruction from the Corporation.
4.1. Pihak Bank telah diberi kuasa untuk mengutip sebarang pembayaran Direct Debit dari Akaun milik Pemegang Akaun setelah menerima Arahan Pembayaran/Arahan Pemotongan daripada pihak Syarikat.
4.2. Where there are available funds in the Account Holder’s Account, but the total funds available in the Account is insufficient to pay for all the Payment/Deduction Instruction(s):
4.2. Apabila terdapat dana di dalam Akaun milik Pemegang Akaun, tetapi jumlah dana yang ada di dalam Akaun tersebut tidak mencukupi untuk membayar semua Arahan Pembayaran/Arahan Pemotongan:
i. the Bank may, in its absolute discretion, decide not to proceed with the Payment / Deduction Instruction(s) and the Bank shall be under no obligation to notify or provide any reason to the Account Holder of its intention to do so;
i. pihak Bank boleh, mengikut budi bicara mutlaknya, membuat keputusan untuk tidak meneruskan dengan Arahan Pembayaran/Arahan Pemotongan dan pihak Bank tidak akan mempunyai sebarang kewajipan untuk memaklumkan atau memberikan apa-apa alasan kepada Pemegang Akaun untuk tindakan tersebut;
ii. The Bank may, in its absolute discretion, decide to proceed with the Payment/Deduction Instruction(s) and the Bank shall determine the order of priority of the Payment / Deduction Instruction(s) as the Bank deems fit.
ii. Pihak Bank boleh, mengikut budi bicara mutlaknya, membuat keputusan untuk meneruskan Arahan Pembayaran/Arahan Pemotongan dan pihak Bank akan menentukan susunan keutamaan Arahan Pembayaran/Arahan Pemotongan yang difikirkan sesuai oleh pihak Bank.
- Charges / Caj
5.1. The Bank reserves the right to levy a service charge for each successful Direct Debit Service transaction. The Bank also reserves the right to vary such charges from time to time or impose other charges as deemed appropriate in providing the Direct Debit Service upon giving the Account Holder twenty-one (21) calendar day’s prior notice. Such variation or the imposition of additional charges shall be displayed at the Bank's premises or the Bank's website.
5.1. Pihak Bank berhak untuk mengenakan sebarang caj perkhidmatan bagi setiap transaksi Perkhidmatan Direct Debit yang berjaya. Pihak Bank juga berhak untuk mengubah caj tersebut dari semasa ke semasa atau mengenakan sebarang caj lain yang dianggap sesuai dalam menyediakan Perkhidmatan Direct Debit setelah memberi notis selama dua puluh satu (21) hari kalendar kepada Pemegang Akaun. Apa-apa pengubahsuaian atau pengenaan caj tambahan hendaklah dinyatakan di premis atau laman web pihak Bank.
- Liability / Liabiliti
6.1. To the fullest extent permitted by Law, the Bank and the Direct Debit Operator shall not be held responsible or liable to the Account Holder or any third party for any claims, loss, damages, cost and expenses (including without limitation any direct, indirect, consequential, incidental loss or damage) arising out of or resulting from any person using the Direct Debit Service, including but not limited to, any person giving the Payment/Deduction Instruction purportedly in the Account Holder’s name, the successful or unsuccessful Payment/Deduction Instruction, wrongful debit of Account due to inaccurate information provided by the Account Holder or the Corporation or the Corporation’s bank and other factors beyond the control of the Bank. Under such circumstances, the Account Holder shall seek recourse or resolve the claims directly with the Corporation.
6.1. Setakat yang dibenarkan oleh Undang-Undang, pihak Bank dan Pengendali Direct Debit tidak akan bertanggungjawab atau bertanggungan kepada Pemegang Akaun atau mana-mana pihak ketiga di atas sebarang tuntutan, kerugian, kerosakan, kos dan perbelanjaan (termasuk tetapi tidak terhad kepada apa-apa sama ada secara langsung, tidak langsung, berbangkit, kerugian atau kerosakan sampingan) akibat daripada mana-mana pihak menggunakan Perkhidmatan Direct Debit, termasuk tetapi tidak terhad kepada, mana-mana pihak yang memberikan Arahan Pembayaran/Arahan Pemotongan atas nama Pemegang Akaun, sama ada Arahan Pembayaran/Arahan Pemotongan tersebut berjaya atau tidak berjaya, tersalah debitkan Akaun disebabkan oleh maklumat yang tidak tepat diberikan oleh Pemegang Akaun atau pihak Syarikat atau bank bagi pihak Syarikat dan faktor-faktor lain yang di luar kawalan pihak Bank. Dalam keadaan tersebut, Pemegang Akaun hendaklah mendapatkan rekursa atau menyelesaikan sebarang tuntutan terus dengan pihak Syarikat.
- Indemnity / Indemniti
7.1. The Account Holder hereby agrees to defend, indemnify and hold harmless the Bank and the Direct Debit Operator (including its affiliates and their respective directors, officers, employees and agents) against all actions, proceedings, claims, damage, cost, expenses, demands and losses howsoever arising out of the use of the Direct Debit Service including errors or omissions on the Account Holder’s part and/or the Corporation.
7.1. Pemegang Akaun dengan ini bersetuju untuk membela, menanggung dan melindungi pihak Bank dan Pengendali Direct Debit (termasuk syarikat-syarikat bersekutu beserta pengarah-pengarah, pegawai-pegawai, pekerja-pekerja dan ejen-ejen) terhadap segala tindakan, prosiding, tuntutan, kerosakan, kos, perbelanjaan, tuntutan dan kerugian yang timbul akibat penggunaan Perkhidmatan Direct Debit termasuk sebarang kesilapan atau ketinggalan oleh Pemegang Akaun dan/atau pihak Syarikat.
- Termination / Penamatan
8.1. The Account Holder’s subscription to the Direct Debit Service shall remain in full force and terminate on the expiry date as stated in the Account Holder’s Direct Debit Authorisation form.
8.1. Langganan Pemegang Akaun untuk Perkhidmatan Direct Debit akan kekal berkuat kuasa dan hanya akan tamat tempoh pada tarikh yang dinyatakan di dalam Borang Kebenaran Direct Debit oleh Pemegang Akaun .
8.2. The Account Holder may / Pemegang Akaun boleh :
i. terminate its subscription to the Direct Debit Service by giving twenty-one (21) calendar day’s prior written notice to the Bank and/or the Corporation which shall include submitting the Direct Debit Authorisation form for termination or by any other method as advised and agreed by the Bank and/or the Corporation Notwithstanding the aforesaid, the Account Holder shall be responsible to settle any outstanding amount due to the Corporation prior to termination.
i. menamatkan langganan Perkhidmatan Direct Debit dengan memberi notis bertulis selama dua puluh satu (21) hari kalendar kepada pihak Bank dan/atau Syarikat termasuk mengemukakan Borang Kebenaran Direct Debit bagi proses penamatan atau mana-mana kaedah lain seperti yang dimaklum dan dipersetujui oleh pihak Bank dan/atau Syarikat. Walaubagaimanpun, Pemegang Akaun akan bertanggungjawab untuk menyelesaikan sebarang jumlah tertunggak yang perlu dibayar kepada pihak Syarikat sebelum sebarang penamatan.
ii. stop payment to be initiated under the Payment/Deduction Instruction by giving twenty-one (21) calendar day’s written notice to the Bank prior to such Payment/Deduction Instruction being initiated by the Corporation.
ii. sebarang pemberhentian pembayaran di bawah Arahan Pembayaran/Arahan Pemotongan hanya akan dilaksanakan dengan memberi dua puluh satu (21) hari kalendar notis bertulis kepada pihak Bank sebelum Arahan Pembayaran/Arahan Pemotongan dilaksanakan oleh pihak Syartikat.
8.3. The Bank may / Pihak Bank boleh:
i. upon being advised by the Corporation, terminate the Account Holder’s Direct Debit Authorisation either with or without notice. In the event a notice is issued, the Bank will give twenty-one (21) calendar day’s prior written notice to the Account Holder.
i. setelah dimaklumkan oleh pihak Syarikat, menamatkan Kebenaran Direct Debit Pemegang Akaun sama ada melalui notis atau tanpa notis. Sekiranya notis dikeluarkan, Bank akan memberi dua puluh satu (21) hari kalendar notis bertulis kepada Pemegang Akaun.
ii. without notice, terminate the Account Holder’s subscription to the Direct Debit Service if the Bank, Corporation, Corporation’s bank and/or the Direct Debit Operator, in its absolute discretion finds, suspects or has reason to believe that the Account Holder used the Direct Debit Service for any unlawful activity.
ii. tanpa notis, menamatkan langganan Pemegang Akaun untuk Perkhidmatan Direct Debit jika pihak Bank, Syarikat, bank pihak Syarikat dan/atau Pengendali Direct Debit, mengikut budi bicara mutlaknya mendapati, mengesyaki atau mempunyai sebab untuk mempercayai bahawa Pemegang Akaun telah menggunakan Perkhidmatan Direct Debit untuk sebarang aktiviti yang menyalahi undang-undang.
8.4. The Account Holder’s Payment/Deduction Instruction will remain effective (in respect of payments made in good faith) notwithstanding the Account Holder’s death, bankruptcy, dissolution, winding up or the revocation of the Direct Debit Authorisation form by any other means, until actual notice of such event(s) is received by the Bank and/or the Corporation.
8.4. Arahan Pembayaran/Arahan Pemotongan oleh Pemegang Akaun akan kekal berkuat kuasa (bagi pembayaran yang dibuat dengan niat yang baik) tanpa mengira jika berlaku kematian pihak Pemegang Akaun, kebankrapan, pembubaran, penggulungan atau pembatalan Borang Kebenaran Direct Debit dengan apa jua kaedah, sehingga notis sah memaklumkan tentang kejadian-kejadian tersebut diterima oleh pihak Bank dan/atau Syarikat.
- Amendments by the Account Holder or the Bank / Pindaan oleh Pemegang Akaun atau pihak Bank
9.1. The Account Holder may amend the details provided in the Direct Debit Authorisation form by submitting a new Direct Debit Authorisation form to the Corporation or by any other method as advised by the Corporation. In any event, any amendment in the Direct Debit Authorisation form will only take effect on the date of receipt by the Bank.
9.1. Pemegang Akaun boleh meminda butiran yang diberikan dalam Borang Kebenaran Direct Debit dengan mengemukakan Borang Kebenaran Direct Debit yang baru kepada pihak Syarikat atau mana-mana kaedah lain seperti yang dimaklumkankan oleh pihak Syarikat. Dalam apa jua keadaan, sebarang pindaan kepada Borang Kebenaran Direct Debit hanya akan berkuat kuasa pada tarikh penerimaan oleh pihak Bank.
- Discontinuance of the Direct Debit Service / Penamatan Perkhidmatan Direct Debit
10.1. The Bank and/or the Direct Debit Operator reserves the right at any time, by giving the Account Holder prior notice to discontinue, interrupt, withdraw or suspend the Direct Debit Service in whole or in part without assigning any reason whatsoever. The Bank and/or the Direct Debit Operator shall not be held liable for any loss or damage which may be suffered by the Account Holder or any other party as a result of such action by the Bank and/or the Direct Debit Operator.
10.1. Pihak Bank dan/atau Pengendali Direct Debit berhak pada bila-bila masa dengan memberi notis kepada Pemegang Akaun untuk memberhenti, mengganggu, menarik balik atau menggantung Perkhidmatan Direct Debit secara keseluruhan atau sebahagian tanpa perlu menyatakan sebarang sebab. Pihak Bank dan/atau Pengendali Direct Debit tidak akan bertanggungjawab terhadap sebarang kerugian atau kerosakan yang mungkin dialami oleh Pemegang Akaun atau mana-mana pihak lain akibat daripada tindakan tersebut oleh pihak Bank dan/atau Pengendali Direct Debit.
- Confidentiality / Kerahsiaan
11.1. The Account Holder acknowledge and understands that the Bank and/or the Corporation may be required to disclose any information provided in the Direct Debit Authorisation form, including the Account Holder’s personal data, as part of subscribing to the Direct Debit Service where it is specifically required or permitted by law, and for the purpose related to the performance of these Terms and Conditions. Where disclosure is required, the Bank and/or Corporation will comply with the Personal Data Protection Act 2010 (hereinafter referred to as the "PDPA"). The term ‘personal data’ shall have the meaning set out in the PDPA.
11.1. Pemegang Akaun mengakui dan memahami bahawa pihak Bank dan/atau Syarikat mungkin dikehendaki untuk mendedahkan sebarang maklumat yang dinyatakan di dalam Borang Kebenaran Direct Debit, termasuk data peribadi Pemegang Akaun, sebagai sebahagian daripada langganan kepada Perkhidmatan Direct Debit seperti yang dikehendaki atau dibenarkan oleh undang-undang secara khusus, dan bagi tujuan yang berkaitan dengan pelaksanaan Terma dan Syarat ini. Jika pendedahan maklumat diperlukan, pihak Bank dan/atau Syarikat akan mematuhi Akta Perlindungan Data Peribadi 2010 (selepas ini dirujuk sebagai "PDPA"). Istilah ‘Data Peribadi’ adalah mempunyai maksud seperti yang dinyatakan dalam PDPA.
11.2. The Account Holder hereby acknowledge and consent that the information provided in the Direct Debit Authorisation form will be disclosed or released to its Bank, Corporation, Corporation’s bank, and Direct Debit Operator for the purpose of the Direct Debit Service.
11.2. Pemegang Akaun dengan ini mengakui dan memberi kebenaran bahawa maklumat yang dinyatakan di dalam Borang Kebenaran Direct Debit untuk didedah atau dikongsi kepada pihak Bank, Syarikat, bank pihak Syarikat, dan Pengendali Direct Debit bagi tujuan Perkhidmatan Direct Debit.

12.1. This Terms and Conditions shall be governed in accordance with the Laws of Malaysia.

BLUEDUCK ZERO DEPOSIT PROGRAM AND BD PAY
Landlord acknowledges that no deposit will be required according to the BlueDuck’s selected ‘Zero Deposit Program’ and only an advance rental is required to be paid by the Tenant stipulated under “Advance Rent Payment” in the Schedule A herein provided that:
a. The Tenant must be able to demonstrate that they have the minimum essential requirements via the due diligence conducted by the BlueDuck;
b. To use BlueDuck’s solutions, the Tenant and Landlord agree to adopt the BlueDuck direct debit solution (a.k.a. “BD Pay”) for online rent payment on a monthly basis (which includes a chargeable system fee of 1% based on the rental amount in our system);
c. The monthly rental stipulated in Schedule A hereto shall be due and payable in advance on the 1st day of every rental payment cycle as per the tenancy agreement;
d. The Tenant shall sign up for the recurring payments to pay the Rent via the BD Pay;
e. In the event of a runaway tenant or defaulted rental, Tenant’s record shall be entered into BlueDuck’s preferred credit agency and BlueDuck’s tenant feedback listing*;
f. Early termination terms shall be subject to the existing tenancy agreement between the Landlord and Tenant. Disputing parties shall endeavor, in good faith, to resolve any disputes through negotiations. If the parties fail to resolve the dispute, Landlord shall be entitled to submit a claim to BlueDuck accordingly which is subject to BlueDuck’s approval.
g. Rental received will be transferred to the Landlord within T+3 working days.
*To remove their records, Tenant shall be liable to reimburse BlueDuck based on the claim amount payout
